Carls Coffee Roastery Pty(Ltd), (CCR) may amend or update these Terms and conditions from time to time with or without notice.
The Carls Coffee online ordering service (Online ordering Service) is administered by a third party provider.
Definitions
Individually owned and operated CCR relations to the operation of a kiosk, including but not limited to the marketing of such goods and services. Any exchange of information between the User and CCR and/or a Kiosk using the online ordering service (‘Submissions”)
CANCELLATIONS AND CHANGES
Users of the online ordering service are required to choose orders carefully as refunds or changes to any order are not able to be made once an order placed. It is at the sole discretion of the individual Kiosk which the order has been placed as whether they choose to allow a change to an order once it has been received.
USE OF THE ONLINE ORDERING SERVICE
If the online ordering service is used (for any purpose) you are responsible for maintaining the confidentiality of your personal details, password and payment details. You agree to accept full responsibility for all your activities on our website and online ordering.
The online ordering service must only be used by persons over the age of eighteen years or otherwise under the supervision of an adult or guardian. CCR reserves the right to refuse service, terminate your access to the website or online ordering, remove or edit any content or cancel your order/s in its sole discretion and without prior notice to you.
In making the online ordering service available tor use CCR merely acts as an agent of the Kiosk from which the products or services will be provided (as selected by your or determined based on proximity to the delivery address) CCR does not provide you with any goods or services and makes no warranties or representations regarding the goods and services to be provided (including availability and delivery).
CCR does not guarantee that the online ordering service will be free from viruses or other harmful components and you agree to hold harmless CCR and any Kiosk from any claim, judgement, loss, expense, liability from any viruses or harm suffered by you as result of using the online ordering service. CCR reserves the right to alter the agreed price an incorrect price was cause by software fault, error or malicious attack.
In using the online ordering service, you acknowledge that all orders are treated as an express intention to purchase the nominated goods or services for the agreed online prices and that you contract with CCR. You acknowledge you have no claim, recourse or action against CCR whatsoever and indemnify CCR from all claims, losses, judgement liability and damage relating to a failure of the online ordering service.
INDEMNITY
Your agree to defend, indemnify and hold harmless CCR, the HEAD OFFICE OF CCR these entities, from and against any and all clams, damages, obligations, losses liabilities, costs or debt and expenses (including but not limited to legal fees) arising from or in connection with (i) your use of and access to the website (including any online ordering) (ii) your violation of any terms of these Terms and Conditions of Use and (iii) your violation of an third party rights, including without limitation ant Intellectual Property, Registrate Trademarks and Copyright (iv) any claim that one of your User Submission caused damage to a third party (v) use of the User Submissions by CCR.
ABILITY TO ACCEPT TERMS AND CONDITIONS OF USE
You affirm that you are 18 years of age or older, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions of Use, and to abide by and comply with these Terms and Conditions of Use.
